Affordable Care Act (Obamacare) is indeed constitutional. I guess I should be out celebrating in the streets for a victory for Obama. Not exactly. I am happy that at least we have something in place that assures that Americans regardless of employment status, age or pre-existing conditions will be able to buy health insurance. But, it's not lost on me that a majority of Americans oppose "Obamacare" as a whole- while a majority of Americans also agree with just about all of its major provisions.
It seems everyone has forgotten that Barack Obama himself was opposed to the individual mandate during his candidacy. One of the differentiators between Obama and Hillary Clinton was Hillary was for the individual mandate while Obma favored a public option. The individual mandate is an idea that originated in a Conservative think tank and was an idea endorsed by many Republicans, including Congressmen and Senators, right up until President Obama proposed it. It was known as "individual responsibility" before it became socialism and government overreach. It was included in the Affordable Care Act as a way of reaching out to Conservatives. I don't know too many Liberals and no Libertarians who like the idea of the individual mandate. And, the Republican Party has done such an excellent job of a turnabout that it seems most Republicans either have forgotten or don't know this was their idea. The idea was to protect the private insurance industry and keep them profitable while they had to cover the sick people they have been dropping. Instead of giving those sick people a government run option, we were going to force the insurance companies to cover them. In exchanged, the industry insisted it need to force well people to pay, too. Mitt Romney, one of the first and few governors to actually implement an individual mandate now finds it unconstitutional. So, Republicans hate the individual mandate as do many Liberals, Independents and Libertarians.
Obamacare is far from perfect. I'd love to see the individual mandate dropped in favor of an government-run option for those people the private companies refuse to cover or who they blackmail with outrageous rates. But, Obamacare is better than what we had before and the good thing is that it has set a precedent that will keep people from going back to what we had before. Even Mitt Romney's slogan now is Repeal AND Replace. He will not be able to simply dismantle it without keeping the many of the provisions it set in place. And that is a good thing.
